Viacom, media conglomerate keeping MTV and Comedy Central, in its reigns, is suing Youtube and its parent site, Google. The lawsuit is for $1 billion dollars and is based on "massive international copyright infringement." Viacom has demanded that Youtube remove 100,000 video clips from the site. --------------------------------------- FROM YOUTUBE Founded in February 2005, YouTube is the leader in online video, and the premier destination to watch and share original videos worldwide through a Web experience. YouTube allows people to easily upload and share video clips on -[link]- and across the Internet through websites, mobile devices, blogs, and email. Everyone can watch videos on YouTube. People can see first-hand accounts of current events, find videos about their hobbies and interests, and discover the quirky and unusual. As more people capture special moments on video, YouTube is empowering them to become the broadcasters of tomorrow. YouTube received funding from Sequoia Capital in November 2005 and was officially launched one month later in December. Chad Hurley and Steve Chen proceeded to become the first members of the YouTube management team and currently serve as Chief Executive Officer and Chief Technology Officer respectively. In November 2006, within a year of its launch, YouTube was purchased by Google Inc. in one of the most talked-about acquisitions to date. YouTube has struck numerous partnership deals with content providers such as CBS, BBC, Universal Music Group, Sony Music Group, Warner Music Group, NBA, The Sundance Channel and many more. From Youtube pertaining to copyrighted material Copyright Infringement Notification To file a copyright infringement notification with us, you will need to send a written communication that includes substantially the following (please consult your legal counsel or see Section 512(c)(3) of the Copyright Act to confirm these requirements): A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Please also note that under Section 512(f) any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. ---------------------- Youtube makes it clear, inform us of the material which infringes copyright laws, and it will be removed. Taken from "YouTube reaches deals for music video, sports content" by Fred O'connor, IDG News Service 27 FEB 2007 -[link]- "Earlier this month YouTube complied with a request from Viacom International Inc. to remove over 100,000 of its clips, including content from MTV, VH1, Nickelodeon, Nick at Nite, Comedy Central and Paramount Pictures." ----------------------------------------------- More to come when more is available. Considering I tried to only give information on the above post, i will post my views here...... 1 BILLION DOLLARS.........are you fucking kidding me, Google only paid 1.65 billion dollars for the whole site, not to mention the 'clips' in discussion are fucking CLIPS not whole episodes.... Youtubes motts is "Broadcast yourself" and as stated in their about us section which i posted above--"YouTube allows people to easily upload and share video clips on [link] and across the Internet through websites, mobile devices, blogs, and email." PEOPLE POST VIDEOS not youtube, and in the COPYRIGHT section which i have also posted...." Please also note that under Section 512(f) any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability." YOUR RESPONSIBLE FOR ILLEGAL POSTS not us.......viacom cant sue everyperson who posts illegal copyrighted material so they use the bullshit easy answer...sue youtube. Even though youtube offers to take the copyrighted material and has already complied with the removal of 100,000 videos.... It is my belief that this is not an attempt to have their copyrighted material removed, but to have Youtube SHUT DOWN.....googles taking over get used to it. |

Ok Nate. Take a deep breath. YouTube has members on there that have full episodes of shows on their site. It may not be all together but broken down into 10 or 15 minutes segments of episode whatever part 1,2, and 3. It means that YouTube as the "parent" company is responsible for the content on their site. In that same way if they were hosting a bunch of bank phishes on their site. If it's illegal, they may have not put it on there but they are responsible for it. During a lawsuit, YouTube is going to add the members that posted the videos in question under the lawsuit basically claiming that the members share responbility for this lawsuit. The member for actually posting it and YouTube for not pulling it off. YouTube will also claim they have a legal disclaimer relieving them of responsibility that is electronically signed by the member when they create their account. This is what the attornies will argue in court for a Judge to pass judgement on. Also, I'd like to remind you of something else. Companies, such as AOL, pay companies like Viacom millions of dollars to host their full shows on their site. There is a site -videos.aol.com- where members can watch full length episodes among many other things. My company, among many others, pays millions to other companies that own the material for our right to use it. Having these videos posted somewhere else means the company that owns the material is losing money, which may really be close to $1 billion lost, but also the company paying for it's use. Just some FYI. |

google = free... all google wants is information about you and shit. Anyway... this is bullshit. it's the responsibility of the corporations to tell individual people to get their vids off. They just don't want to waste their time/money/resources doing that... so they'e doing the American thing... and suing. |

Wait. I'm confused. What are you trying to say? It's the responsibility of the corporations to get individual people to remove copyrighted videos from their site? Yes. That's correct. But who are you referring to when you say "They just don't want to..."??? Are you referring to Viacom for sueing another site outside of their control to have their copyrighted material removed???? Cause then you're wrong. Viacom isn't responsible for another site's actions. It's not the "Amercian thing" to do. It's a multi-billion $ business sueing another business for using Viacom's copyrighted work without an agreement to host it on that particular site.

you always sue for more than you are going to get. that's why you see geeks off the street suing mcdonalds for hundreds of millions. IF they win (big if), you can bet they won't be getting a billion dollars. plus taxes, court fees, etc.

anybody ever watch the google master plan thingy? i dunno if its true or not. maybe it is maybe its not. but eh. anyways. i think what nate it is true. youtube gives people the chance to share their own videos and whatever people decide to upload isn't youtubes responsibility, thats why theres the agreements when you sign up and stuff. and youtube can't watch over 1000 videos posted up every minute.

Ok. It seems like some of you guys here thing GOOGLE is suing youtube. They're the ones GETTING sued, because they're the parent site of youtube. "Viacom, media conglomerate keeping MTV and Comedy Central, in its reigns, is suing Youtube and its parent site, Google." Just seemed like some of you thought that. Edited Thu Mar 15 2007, 12:06AM |
